Terms of Use

These Terms govern your access to and use of the Blue Recruiting website. By using the site you agree to be bound by them.

These Terms of Use (“Terms”) govern your access to and use of the website located at bluerecruiting.co.za and any subdomains (the “Website”), operated by Blue Recruiting (Pty) Ltd, a company registered in the Republic of South Africa under registration number 2014/001282/07, trading as Blue Recruiting (“Blue Recruiting”, “we”, “us”, or “our”).

By accessing or using the Website, you (“you” or “User”) agree to be bound by these Terms. If you do not agree, you must not use the Website.

These Terms govern your use of the Website only. They do not govern the commercial recruitment services we provide to clients or candidates, which are subject to separate written agreements.

2. Acceptance and amendment of these Terms

2.1 By accessing, browsing, registering on, submitting information through, or otherwise using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2.2 We may amend these Terms at any time by posting an updated version on the Website. The “Last updated” date at the top of these Terms will reflect the date of the most recent change. Your continued use of the Website after any such amendment constitutes your acceptance of the amended Terms.

2.3 It is your responsibility to review these Terms periodically.


3. Eligibility

3.1 You may only use the Website if you are at least 18 years of age and legally able to enter into binding contracts in your jurisdiction.

3.2 By using the Website, you warrant that you meet these eligibility requirements.


4. Permitted use of the Website

4.1 The Website is provided for the following purposes:

  • to provide information about Blue Recruiting and our services;
  • to allow prospective clients to enquire about engaging our services;
  • to allow candidates to view advertised roles and submit applications;
  • to publish insights, articles, and other content; and
  • for any other lawful purpose related to our recruitment business.

4.2 You agree to use the Website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use of the Website by, any third party.


5. Prohibited conduct

You must not, and must not permit any third party to:

  • use the Website in any way that breaches any applicable local, national, or international law or regulation;
  • use the Website to send, knowingly receive, upload, download, or use any material that does not comply with our content standards in clause 6;
  • transmit any unsolicited or unauthorised advertising or promotional material or any other form of solicitation (spam);
  • knowingly transmit any data, send or upload any material that contains viruses, trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs or similar computer code;
  • attempt to gain unauthorised access to the Website, the server on which the Website is stored, or any server, computer, or database connected to the Website;
  • attack the Website via a denial-of-service attack or a distributed denial-of-service attack;
  • scrape, harvest, or otherwise extract data from the Website (including candidate, role, or contact information) by automated means or for the purpose of building or augmenting a competing database, recruitment service, or commercial product;
  • reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software underlying the Website; or
  • use the Website to impersonate any person or misrepresent your identity or affiliation with any person or organisation.

6. User-submitted content

6.1 The Website allows you to submit information including, without limitation, contact details, CVs, work history, qualifications, references, and other personal information (collectively, “User Content”), whether through application forms, contact forms, or email.

6.2 You warrant that:

  • all User Content you submit is accurate, complete, and not misleading;
  • you have the right to submit the User Content and to grant the licence in clause 6.3;
  • where User Content includes the personal information of third parties (for example, referees or previous employers), you have obtained the necessary consent or have another lawful basis under applicable data protection law for sharing that information with us; and
  • the User Content does not contain any unlawful, defamatory, obscene, harassing, or infringing material.

6.3 By submitting User Content, you grant Blue Recruiting a non-exclusive, royalty-free, worldwide licence to use, store, process, and share the User Content for the purposes of providing recruitment services, in accordance with our Privacy Policy and applicable law.

6.4 We may refuse, edit, or remove any User Content at our sole discretion, without notice and without liability to you.


7. Job listings and recruitment information

7.1 Job advertisements and role information published on the Website are provided for general information purposes. They are subject to change and may be withdrawn at any time without notice.

7.2 The submission of an application through the Website does not constitute an offer of employment, a guarantee of an interview, or any obligation on the part of Blue Recruiting or any client.

7.3 Information about salaries, benefits, working arrangements, and similar matters is indicative only. Final terms are determined between the candidate and the employing client.

7.4 Blue Recruiting acts as an intermediary. We are not the employer of candidates we place through traditional recruitment services, and we accept no liability for the conduct, decisions, or contractual performance of any client or any candidate. The Remote International service described on the Website operates under a separate model and is governed by a separate written agreement; nothing in these Terms applies to that service.


8. Intellectual property

8.1 All intellectual property rights in the Website, including without limitation all text, graphics, logos, images, audio, video, software, source code, design, layout, and the compilation thereof (the “Site Content”), are owned by or licensed to Blue Recruiting and are protected by South African and international intellectual property laws.

8.2 The Blue Recruiting name, logo, and any product or service names and slogans appearing on the Website are trademarks of Blue Recruiting. You may not use any of these without our prior written permission.

8.3 You may view, download, and print pages from the Website for your own personal or internal business use, subject to the restrictions set out in these Terms. You must not:

  • modify the paper or digital copies of any materials you have printed off or downloaded in any way;
  • use any illustrations, photographs, video or audio sequences, or any graphics separately from any accompanying text; or
  • republish, reproduce, distribute, sell, license, or otherwise exploit any Site Content for commercial purposes without our prior written consent.

9. Links to third-party websites

9.1 The Website may contain links to websites operated by third parties (for example, our LinkedIn page or job postings on third-party platforms). These links are provided for convenience only.

9.2 We have no control over the content of third-party websites and accept no responsibility for them or for any loss or damage arising from your use of them. The inclusion of a link does not imply endorsement.


10. Privacy and protection of personal information

10.1 Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10.2 We process personal information in accordance with the Protection of Personal Information Act, 4 of 2013 (“POPIA”) and, where applicable, the EU General Data Protection Regulation, the UK General Data Protection Regulation, and other applicable data protection laws in jurisdictions in which we operate.

10.3 You may exercise your rights in respect of your personal information by contacting us at the details in clause 1.


11. Disclaimers

11.1 The Website and all Site Content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Blue Recruiting makes no representations or warranties of any kind, express or implied, regarding the Website, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Website will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

11.2 While we make reasonable efforts to ensure the accuracy of information on the Website, we do not warrant that any content on the Website is accurate, complete, current, or reliable.

11.3 Nothing on the Website is intended to constitute legal, financial, tax, employment, or other professional advice. You should not rely on any Website content without seeking appropriate professional advice.


12. Limitation of liability

12.1 Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under the Consumer Protection Act, 68 of 2008, POPIA, or any other applicable South African law.

12.2 Subject to clause 12.1, Blue Recruiting will not be liable to you, whether in contract, delict (including negligence), breach of statutory duty, or otherwise, for any:

  • loss of profits, revenue, business, anticipated savings, or goodwill;
  • loss or corruption of data;
  • loss of opportunity, including any failure to secure or retain employment, or any failure to fill a role; or
  • indirect, special, incidental, or consequential loss or damage,

arising out of or in connection with your use of, or inability to use, the Website or any Site Content.

12.3 Subject to clause 12.1, our total aggregate liability to you arising out of or in connection with your use of the Website, whether in contract, delict, or otherwise, is limited to ZAR 1,000 (one thousand South African Rand).

12.4 The limitations in this clause 12 apply only to your use of the Website. They do not apply to, and do not limit, the liabilities, obligations, or remedies set out in any separate written services agreement between Blue Recruiting and a client or candidate.


13. Indemnity

You agree to indemnify and hold harmless Blue Recruiting, its directors, employees, and contractors, from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • your breach of these Terms;
  • your violation of any applicable law or the rights of any third party; or
  • any User Content you submit, to the extent that such User Content is inaccurate, misleading, or infringes the rights of any third party.

14. Suspension and termination

14.1 We may suspend, withdraw, or restrict your access to all or any part of the Website at any time, without notice and without liability to you, for any reason including without limitation a suspected breach of these Terms.

14.2 The provisions of clauses 6.3, 8, 11, 12, 13, 15, and 16 survive any termination or expiry of these Terms.


15. Governing law and jurisdiction

15.1 These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of the Republic of South Africa.

15.2 You agree that the courts of the Republic of South Africa have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, subject to our right to bring proceedings against you in any other court of competent jurisdiction.

15.3 Where you access the Website from outside the Republic of South Africa, you do so at your own initiative and are responsible for compliance with any applicable local laws.


16. General

16.1   Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Blue Recruiting in relation to your use of the Website.

16.2   Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

16.3   No waiver

Our failure or delay to enforce any right under these Terms does not constitute a waiver of that right.

16.4   Assignment

You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms at any time.

16.5   Notices

Notices to us must be sent to contact@bluerecruiting.co.za. We may give you notice by email (to any address you have provided) or by posting a notice on the Website.

16.6   No agency

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Blue Recruiting.
